TERMS AND CONDITIONS — Applicable to Customers Using the Mehndi Wala Platform

1.Introduction

These Terms and Conditions (“Terms”, “Terms and Conditions” or “Agreement”) govern your access to and use of the Mehndi Wala website, mobile applications, web applications, software, marketplace services, communication tools, booking functionality, payment-related functionality, customer support services, AI-assisted features, and related technology services (collectively, the “Platform”).

The Platform is owned and operated by Mehndi Wala Arts Pvt. Ltd., a company incorporated under the applicable laws of India (“Company”, “Mehndi Wala”, “we”, “us” or “our”).

By accessing, browsing, registering on, or using the Platform, creating an account, submitting an enquiry, communicating with an Artist, requesting a Booking, making a payment, accepting Booking Terms, or otherwise using the Platform, you (“Customer”, “you” or “your”) acknowledge that you have read and understood these Terms and agree to be bound by them to the extent permitted by applicable law.

If you do not agree with these Terms, you must not use the Platform.

A separate set of terms and conditions may apply to Artists who list or provide Services through the Platform.

2.9“Booking Confirmation”

“Booking Confirmation” means the official confirmation status, Booking ID, confirmation message, invoice, or other confirmation expressly issued by the Platform according to the applicable Platform workflow.

A payment-success message alone does not necessarily constitute Booking Confirmation.

2.10“Booking Terms”

  • the information provided by you is accurate and not misleading;
  • you will comply with applicable laws and regulations;
  • you will use the Platform only for lawful purposes;
  • you will comply with these Terms and applicable Platform policies; and
  • you will provide information reasonably necessary for the processing, support, verification, or completion of a Booking.

Where you act on behalf of another person, family member, organisation, business, or event, you represent that you have the necessary authority to do so.

4.Eligibility

4.1Customer Account Eligibility

Customer accounts are intended for persons who are legally capable of entering into binding agreements under applicable law.

Unless otherwise expressly permitted by the Platform or applicable law, Customers must be at least 18 years old.

4.2Services for Minors

A Customer may arrange a Service for a minor where legally permitted.

The Customer or lawful parent/guardian remains responsible for:

  • obtaining appropriate consent;
  • providing accurate information;
  • informing the Artist of relevant allergies or sensitivities;
  • supervising the minor where appropriate; and
  • complying with applicable Service requirements.

The Platform does not knowingly permit minors to independently create accounts where applicable law requires an adult account holder.

5.Nature of Mehndi Wala

5.1Technology-Enabled Marketplace

Mehndi Wala operates as a technology-enabled marketplace and discovery platform intended to help Customers discover, compare, communicate with, and book independent Artists.

5.2Independent Artists

Artists are independent service providers.

Unless expressly stated otherwise, Artists are not employees, agents, partners, franchisees, or representatives of the Company merely because they use the Platform.

The Company does not itself provide the Mehndi Service booked from an Artist unless expressly stated otherwise.

5.3No General Agency

Nothing in these Terms creates an employment relationship, partnership, joint venture, franchise, fiduciary relationship, or general agency relationship between the Company and a Customer or between the Company and an Artist.

5.4Limited Platform Role

The Company's role may include providing technology, marketplace discovery, communication tools, booking functionality, payment facilitation, records, customer support, and dispute assistance.

The exact services made available may vary from time to time.

5.5Intermediary Status

To the extent that the Company qualifies as an intermediary or marketplace e-commerce entity under applicable law, the Company may seek to rely upon protections available to eligible entities, subject to all applicable statutory conditions, duties, limitations, and exceptions.

Nothing in these Terms guarantees that any statutory protection, exemption, safe harbour, or limitation of liability will apply in every circumstance.

6.Platform Services

Depending on availability, the Platform may provide Customers with:

  • Artist discovery and search;
  • location-based search;
  • filtering and comparison;
  • Artist profiles and portfolios;
  • enquiries;
  • Platform Chat;
  • booking requests;
  • availability information;
  • quotations;
  • booking summaries;
  • payment functionality;
  • transaction records;
  • invoices;
  • reviews and ratings;
  • customer support;
  • dispute assistance;
  • AI-assisted search and recommendations;
  • notifications;
  • account management; and
  • other features introduced from time to time.

The Company may add, modify, suspend, restrict, or discontinue features subject to applicable law.

7.Customer Account

A Customer may be required to create an account using a mobile number, OTP, password, email address, or another authentication method supported by the Platform.

Customers are responsible for:

  • providing accurate account information;
  • maintaining account security;
  • protecting OTPs and authentication credentials;
  • reviewing Booking information;
  • keeping contact information current;
  • notifying the Company of unauthorised account activity; and
  • ensuring that their account is not knowingly used for fraudulent or unlawful activity.

You must not knowingly allow another person to misuse your account or authentication credentials.

8.Customer Information

You agree to provide accurate and complete information reasonably required for use of the Platform and applicable Services.

Information may include, where relevant:

  • name;
  • mobile number;
  • event date;
  • event type;
  • Service location;
  • number of persons;
  • design requirements;
  • Service preferences;
  • budget information;
  • Booking information;
  • payment information;
  • communication details; and
  • other information required to process or support a Booking.

You are responsible for correcting inaccurate information as soon as reasonably practicable.

9.Customer Responsibilities

Customers are responsible for:

  • providing accurate event information;
  • providing the correct date and time;
  • providing an accurate Service location;
  • communicating relevant Service requirements;
  • informing the Artist about known allergies, sensitivities, or relevant restrictions;
  • providing reasonable access to the agreed Service location;
  • paying amounts due under applicable Booking Terms;
  • following reasonable safety requirements;
  • behaving respectfully toward Artists and other Users;
  • avoiding fraudulent, abusive, or speculative Bookings;
  • reviewing Booking Terms before confirmation; and
  • retaining important Booking and payment records.

Customers should not rely on assumptions regarding price, availability, travel charges, design scope, number of persons, duration, or cancellation rights unless such information forms part of the applicable Booking Terms.

10.Artist Information and Seller Disclosures

Artist profiles may contain information supplied by Artists, including:

  • Artist or business name;
  • profile information;
  • portfolio;
  • service descriptions;
  • service categories;
  • location;
  • service areas;
  • pricing information;
  • experience information;
  • ratings;
  • reviews;
  • availability information; and
  • other information relevant to the Customer's purchasing decision.

The Company may display information provided by Artists in accordance with applicable law and Platform functionality.

Customers should review the information available before making a Booking.

Where applicable law requires specific seller or service-provider information to be displayed, the Company may request and display such information through the relevant Platform interface.

11.Artist Verification

The Platform may verify certain Artist information through KYC, identity verification, business verification, document checks, or other verification processes.

A verification status or badge, where displayed, means only that the Company has completed the particular verification process represented by that status.

Verification does not necessarily mean that:

  • the Artist is certified by the Company;
  • the Artist is professionally licensed unless specifically stated;
  • the Artist's work is guaranteed;
  • every portfolio image has been independently verified;
  • every review is a verified Booking review; or
  • the Artist will provide a satisfactory Service.

12.Search, Ranking and Recommendations

Search results, Artist ordering, recommendations, filters, and discovery experiences may be influenced by factors such as:

  • relevance to the Customer's search;
  • location;
  • Service category;
  • availability;
  • profile completeness;
  • Customer preferences;
  • historical marketplace signals;
  • ratings and reviews;
  • responsiveness;
  • Platform eligibility;
  • technical factors;
  • commercial or promotional features; and
  • other operational or algorithmic factors.

The Company may modify search and recommendation systems from time to time.

The Company does not guarantee that a particular Artist will appear first, remain in a particular position, or be recommended for every Customer.

13.Paid or Boosted Placement

Artists may have access to paid promotional or Boosted Placement features.

Where applicable, paid placement may provide additional visibility.

Paid placement does not constitute:

  • a quality certification;
  • a recommendation of suitability;
  • a guarantee of enquiries;
  • a guarantee of Bookings;
  • a guarantee of revenue;
  • a guarantee of availability; or
  • a guarantee of Service quality.

Where required or appropriate, the Company may identify promotional or sponsored placements within the Platform.

14.Artist Comparison

The Platform may provide tools that allow Customers to compare Artist profiles, pricing information, reviews, portfolios, Service categories, locations, availability indicators, or other information.

Comparison information may be based on information supplied by Artists or processed by Platform systems.

Customers remain responsible for reviewing the underlying information before making a Booking.

15.Enquiries

An enquiry, message, call request, quote request, or expression of interest does not by itself create a Booking.

An Artist may accept, decline, modify, or respond to an enquiry subject to the applicable Platform workflow.

Customers should obtain and review the final Booking Terms before making payment or assuming that a Service has been confirmed.

16.Platform Chat

The Platform may provide Chat or communication tools between Customers and Artists.

Customers should use Platform communication channels for important Booking-related information where available.

The Company may retain or process Platform communications in accordance with the Privacy Policy and applicable law.

Communications taking place entirely outside the Platform may not be visible to the Company and may not be available for dispute review.

17.Booking Process

A Booking may generally involve the following stages:

  • Customer searches or discovers an Artist;
  • Customer reviews Artist information;
  • Customer submits an enquiry or Booking request;
  • Service requirements are discussed;
  • Artist provides or confirms applicable pricing and Booking Terms;
  • availability is checked or confirmed;
  • Customer reviews the Booking Terms;
  • applicable advance payment is made;
  • payment is processed or recorded;
  • the Platform issues Booking Confirmation where applicable; and
  • the Service is subsequently performed.

The actual process may vary depending on the Platform workflow, Artist, Service, payment method, or transaction.

18.Booking Confirmation

A Booking will be treated as confirmed only when the Platform expressly indicates the Booking as confirmed or otherwise issues an official confirmation, Booking ID, invoice, or equivalent confirmation according to the applicable Platform workflow.

Payment success alone does not automatically guarantee Booking Confirmation.

If payment has been successfully processed but the Booking is not confirmed, the Customer should contact Platform Support promptly.

The Company may investigate failed, duplicate, incomplete, reversed, delayed, or incorrectly processed transactions.

19.Booking Terms

Specific Booking Terms may include:

  • Service description;
  • date;
  • start time;
  • end time or estimated duration;
  • Service location;
  • number of persons;
  • design requirements;
  • total price;
  • advance payment;
  • balance payment;
  • taxes;
  • travel charges;
  • additional charges;
  • materials or product conditions;
  • cancellation terms;
  • rescheduling terms;
  • refund terms;
  • special requirements; and
  • other conditions agreed for the Booking.

Customers should carefully review these terms before confirming a Booking.

20.Service Price

The Service price is generally determined by the Artist unless expressly stated otherwise.

Prices may vary according to:

  • Service type;
  • number of persons;
  • design complexity;
  • event type;
  • date;
  • location;
  • travel requirements;
  • duration;
  • materials;
  • special requests;
  • taxes; and
  • other Service-specific factors.

Customers should rely on the final applicable Booking Terms rather than outdated quotations, profile information, screenshots, or informal assumptions.

21.Customer Platform Fees

Where the Platform states that Customers are not charged a Platform booking or convenience fee, no separate Customer Platform fee will be charged except where a fee is clearly disclosed before the relevant transaction or is otherwise legally applicable.

Artist Service prices, Artist travel charges, taxes, and other Artist-specific charges are not necessarily Company Platform fees.

The applicable transaction screen, Booking Terms, invoice, or payment summary should be reviewed before payment.

22.Advance Payment

Where an advance payment is required, the applicable amount will be displayed or communicated before the relevant transaction where reasonably practicable.

There is no universal advance percentage applicable to every Artist or Booking unless expressly stated by the Platform.

The remaining balance, if any, shall be payable according to the applicable Booking Terms.

Customers should retain payment receipts and Booking records.

23.Balance Payment

Where a Booking requires a balance payment, the Customer must pay the balance according to the applicable Booking Terms.

The balance may be payable:

  • through the Platform;
  • directly to the Artist; or
  • through another method expressly permitted under the Booking Terms.

Customers should confirm the payment method and amount before making payment.

24.Payment Processing

Payments may be processed through third-party payment service providers.

Payment providers may apply their own terms, security procedures, verification requirements, transaction limits, processing timelines, and refund procedures.

The Company may receive transaction-related information necessary to process, reconcile, support, document, or investigate payments, subject to the Privacy Policy and applicable law.

The Company does not become a bank, financial institution, or payment institution merely because payment functionality is made available through the Platform.

25.Payment Failure, Duplicate Payment and Transaction Errors

If a payment fails, is duplicated, is reversed, remains pending, or is incorrectly processed, the Customer should contact the Company and, where appropriate, the relevant payment provider.

The Company may investigate transaction records and coordinate with payment service providers.

Refund or adjustment timing may depend on the payment provider, bank, transaction status, and applicable law.

26.Taxes

Each party is responsible for taxes legally applicable to that party or transaction.

Where the Company is legally required to collect, deduct, withhold, report, or remit taxes, the Company may do so.

Tax treatment may vary depending on the nature, value, location, and structure of the transaction.

27.Cancellation

Cancellation rights and consequences depend on the applicable Booking Terms and cancellation/refund policy.

Before confirming a Booking, Customers should review:

  • cancellation deadlines;
  • cancellation charges;
  • refund conditions;
  • advance payment treatment;
  • rescheduling rules;
  • Artist-specific cancellation terms; and
  • any special event or date-related conditions.

There is no universal refund percentage applicable to every Booking.

28.Customer Cancellation

If a Customer cancels a Booking, the consequences may depend on:

  • the time of cancellation;
  • Booking Terms;
  • advance payment;
  • Service date;
  • Artist cancellation policy;
  • availability of replacement Services;
  • applicable Platform policy; and
  • applicable law.

Where a refund is due, it will be processed in accordance with the applicable policy and transaction process.

29.Artist Cancellation or Service Failure

An Artist may cancel or fail to perform a Booking because of circumstances including emergency, illness, unavailability, safety concerns, operational issues, or other reasons.

Where an Artist cancels, fails to appear, significantly delays the Service, or materially fails to provide the agreed Service, the Company may, where appropriate and reasonably practicable:

  • assist the Customer;
  • communicate with the Artist;
  • review Platform records;
  • assist with applicable refund processes;
  • assist with replacement options;
  • restrict or review the Artist account; or
  • take other Platform-level action permitted by law and applicable policies.

The Company does not guarantee that a replacement Artist will be available.

30.Rescheduling

Rescheduling is subject to the applicable Booking Terms, Artist availability, Service date, event requirements, cancellation policy, and applicable law.

A Customer should obtain confirmation of any rescheduled date or time through an appropriate Platform record where available.

A proposed rescheduling discussion does not automatically modify the Booking unless the change is accepted and recorded through the applicable process.

31.Refunds

Where a refund is applicable, the amount and timing may depend on:

  • Booking Terms;
  • cancellation/refund policy;
  • reason for cancellation;
  • Artist obligations;
  • payment status;
  • payment provider processing;
  • banking timelines;
  • transaction status; and
  • applicable law.

Refunds may be made through the original payment method or another permitted method.

Nothing in these Terms excludes a refund, remedy, or consumer right that is mandatory under applicable law.

32.Chargebacks and Payment Disputes

If a Customer initiates a chargeback or payment dispute, the Company may provide relevant transaction records to the applicable payment provider, bank, card network, or financial institution as permitted by law.

The Company may temporarily restrict an account where reasonably necessary to investigate suspected fraud, abuse, or payment misuse.

If a Customer receives a payment or refund to which they are not entitled, the Company may seek correction, recovery, or adjustment to the extent permitted by law.

33.Off-Platform Transactions

Customers and Artists may communicate or transact outside the Platform where legally and technically permitted.

However, transactions completed entirely outside the Platform may not have the same records, controls, support, or dispute assistance available through Platform transactions.

For an off-platform transaction:

  • Platform payment records may not exist;
  • Platform Booking records may be incomplete;
  • Platform dispute assistance may be limited;
  • refund evidence may be limited;
  • the Company may not be able to verify communications or representations;
  • the Company may not be able to confirm payment; and
  • certain Platform protections may not apply.

Customers should retain appropriate records of off-platform transactions.

34.Travel Charges

An Artist may charge travel or location-related charges where legally permitted and disclosed or agreed.

Service locality, Artist service area, exact venue, travel distance, and outstation status may be different concepts.

Customers should confirm applicable travel charges before Booking Confirmation.

The Company is not responsible for an Artist's independently imposed undisclosed charge except to the extent required by applicable law or expressly undertaken by the Company.

35.Additional Service Charges

Additional charges may apply for services or requirements that were not included in the original Booking Terms.

Examples may include:

  • additional persons;
  • additional Service time;
  • materially different Service requirements;
  • additional travel;
  • additional materials;
  • additional venue requirements; or

Customer-requested changes.

Where reasonably practicable, additional charges should be disclosed and agreed before the additional Service is provided.

36.Mehndi Service Results and Expectations

Mehndi results may vary depending on factors including:

  • skin type;
  • body area;
  • natural skin characteristics;
  • aftercare;
  • application technique;
  • product or material used;
  • environmental conditions;
  • duration of application;
  • washing or exposure to water;
  • individual expectations; and
  • other circumstances outside the Company's control.

The Company does not guarantee a particular shade, darkness, longevity, pattern result, stain intensity, design outcome, or artistic result.

Any specific result represented by an Artist should be discussed directly with that Artist.

37.Allergies, Skin Sensitivity and Product Safety

Customers should inform the Artist before the Service about known allergies, skin sensitivities, medical restrictions, or other relevant concerns.

Customers should ask the Artist about the products or materials intended to be used where such information is relevant.

The Company does not provide medical advice or determine whether a particular product or Service is medically suitable for an individual.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

38.Customer Safety

Customers should maintain a reasonably safe environment for the Artist and other persons present during the Service.

An Artist may refuse or stop a Service where reasonably necessary because of:

  • threats;
  • harassment;
  • violence;
  • unsafe working conditions;
  • unlawful activity;
  • dangerous venue conditions;
  • materially different Booking circumstances;
  • abusive conduct; or
  • other legitimate safety concerns,
  • subject to applicable law and the Booking Terms.

Customers must not use threats, intimidation, harassment, violence, discrimination, or abusive behaviour against Artists or other Users.

39.Non-Discrimination

Customers must not use the Platform to unlawfully discriminate against Artists or other Users based on characteristics protected under applicable law.

The Company may take appropriate Platform-level action where unlawful discriminatory conduct is identified.

Nothing in these Terms prevents lawful choices concerning Service requirements, artistic style, language, location, availability, or other legitimate business criteria.

40.Reviews and Ratings

Customers may be permitted to submit reviews and ratings after using a Service or interacting with an Artist.

Reviews must represent the Customer's genuine experience.

Customers must not:

  • submit fake reviews;
  • impersonate another person;
  • accept payment or benefits in exchange for misleading reviews;
  • manipulate ratings;
  • threaten an Artist with a negative review;
  • submit knowingly false factual claims;
  • disclose another person's private information without lawful basis;
  • use reviews to harass or abuse another person; or
  • artificially manipulate the Platform's reputation systems.

The Company may moderate, restrict, or remove reviews that violate applicable policies or law.

41.Verified Reviews

Where a “Verified Review”, “Verified Customer”, or similar status is displayed, that status indicates only the particular verification performed by the Platform.

It does not necessarily mean that:

  • every statement in the review has been independently verified;
  • the review represents the Company's opinion;
  • the Artist is endorsed by the Company; or
  • the review guarantees future Service quality.

42.User-Generated Content

Customers may submit photographs, videos, reviews, messages, descriptions, feedback, or other Content.

You retain ownership of Content that you lawfully own.

By submitting Content to the Platform, you grant the Company a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, distribute, communicate, and use the Content for purposes including operating, maintaining, improving, securing, analysing, and promoting the Platform, subject to applicable law and the Privacy Policy.

The licence does not transfer ownership of your underlying intellectual property to the Company.

You represent that you have the necessary rights, permissions, and authority to submit the Content.

43.Customer Photos and Identifiable Persons

Customers should not upload photographs or other Content containing identifiable persons unless they have the necessary permission or another lawful basis to submit and permit the Company to process the Content.

Customers are responsible for ensuring that their submitted Content does not unlawfully disclose another person's private or sensitive information.

The Company may remove or restrict Content where reasonably necessary for privacy, safety, legal, or Platform-protection reasons.

44.Intellectual Property

The Platform and its original components, including software, interface design, text, graphics, databases, logos, trademarks, service marks, layouts, compilations, and other proprietary materials, are owned by or licensed to the Company unless otherwise stated.

Except as expressly permitted by these Terms or applicable law, Customers must not:

  • copy;
  • reproduce;
  • modify;
  • distribute;
  • sell;
  • lease;
  • commercially exploit;
  • reverse engineer;
  • scrape;
  • systematically extract;
  • create derivative works from; or
  • otherwise misuse
  • the Company's proprietary materials.

Nothing in these Terms transfers ownership of Company intellectual property to a Customer.

45.Intellectual Property Complaints

If you believe that Content on the Platform infringes your copyright, trademark, privacy rights, publicity rights, or another legal right, you may contact the Company with sufficient information to identify:

  • the allegedly infringing Content;
  • your legal interest;
  • the basis of your complaint;
  • supporting evidence; and
  • your contact information.

The Company may investigate and take action as appropriate under applicable law.

46.AI Features and Mehndi Wala AI

The Platform may provide AI-assisted features, including:

  • search assistance;
  • Artist discovery;
  • recommendations;
  • comparisons;
  • summaries;
  • conversational assistance;
  • design discovery;
  • price-related guidance;
  • Service guidance;
  • booking assistance; and
  • other AI-supported functionality.

AI-generated information may contain errors, omissions, outdated information, incomplete information, or incorrect assumptions.

AI output must not be treated as:

  • legal advice;
  • medical advice;
  • financial advice;
  • tax advice;
  • professional certification;
  • a guarantee of Artist quality;
  • a guarantee of price; or
  • a guarantee of availability.

47.AI Availability and Booking Confirmation

Customers must not assume that an AI response constitutes live availability or Booking Confirmation.

An AI assistant may only be treated as providing confirmed availability where the Platform expressly indicates that availability has been checked and confirmed.

Customers should verify important information before payment or confirmation, including:

  • price;
  • date;
  • time;
  • location;
  • Service scope;
  • Artist availability;
  • cancellation terms;
  • travel charges; and
  • final Booking status.

48.AI Price and Recommendation Information

AI-generated price ranges, estimates, recommendations, comparisons, or suggestions are informational unless expressly incorporated into final Booking Terms.

The Artist's confirmed price and the applicable Booking Terms govern the transaction.

An AI recommendation does not constitute an endorsement, guarantee, certification, or promise by the Company.

49.Platform Content Accuracy

The Platform may contain information supplied by Artists, Customers, third-party providers, or automated systems.

The Company takes reasonable steps to maintain useful and accurate Platform information but does not guarantee that every item of information is complete, current, accurate, error-free, or suitable for every purpose.

Customers should verify material information before relying upon it.

50.Third-Party Services

The Platform may use or integrate third-party services, including:

  • payment providers;
  • authentication providers;
  • communication providers;
  • cloud infrastructure;
  • analytics providers;
  • mapping and location services;
  • customer support systems;
  • fraud prevention providers; and
  • other technology providers.

Third-party providers may have their own terms, privacy practices, processing procedures, and service limitations.

The Company is not responsible for independent acts or omissions of third parties except to the extent liability cannot lawfully be excluded.

52.Prohibited Customer Conduct

Customers must not use the Platform to:

  • violate applicable law;
  • commit fraud;
  • create fake accounts;
  • provide materially false information;
  • create fake enquiries or Bookings;
  • manipulate reviews or ratings;
  • misuse promotional offers;
  • impersonate another person;
  • harass, threaten, intimidate, or abuse another User;
  • upload unlawful or infringing Content;
  • distribute malware or malicious code;
  • attempt unauthorised access;
  • scrape or systematically extract Platform data;
  • reverse engineer the Platform except where legally permitted;
  • interfere with Platform security;
  • manipulate rankings or recommendations;
  • misuse personal information;
  • facilitate unlawful financial transactions;
  • circumvent legitimate Platform controls;
  • falsely claim Company endorsement;
  • misuse Artist or Customer information;
  • use the Platform for unlawful discrimination; or
  • otherwise misuse the Platform.

53.Customer Personal Data and Artist Information

Customers may receive access to Artist information for the purpose of discovering and arranging Services.

Customers must not misuse Artist personal information, including:

  • mobile numbers;
  • addresses;
  • venue details;
  • photographs;
  • event information;
  • booking information;
  • business information; or
  • other personal information
  • obtained through the Platform.

Such information must not be:

  • sold;
  • commercially resold;
  • used for unrelated marketing;
  • publicly disclosed without lawful basis;
  • used for harassment;
  • used for stalking;
  • used for fraud; or
  • shared with unrelated third parties without lawful basis.

Customers must use such information only for legitimate purposes connected with the relevant Service or Booking, unless otherwise permitted by law.

54.Fraud, Abuse and Risk Controls

The Company may use reasonable technical, manual, automated, or risk-based measures to detect:

  • fraudulent accounts;
  • suspicious payments;
  • fake Bookings;
  • duplicate accounts;
  • abusive behaviour;
  • suspicious reviews;
  • identity inconsistencies;
  • payment misuse;
  • security threats;
  • data misuse; and
  • other forms of Platform abuse.

The Company may request additional information or temporarily restrict functionality while an investigation is conducted.

55.Content Moderation and Removal

The Company may review, moderate, restrict, disable, or remove Content where reasonably necessary because of:

  • violation of these Terms;
  • violation of Platform policies;
  • applicable law;
  • court or government direction;
  • privacy concerns;
  • safety concerns;
  • intellectual property complaints;
  • fraud;
  • security risks;
  • misleading information; or
  • other legitimate Platform-protection reasons.

Nothing in this section removes rights available under applicable law.

56.Privacy and Personal Data

The collection, use, storage, disclosure, sharing, retention, and other processing of personal data are governed by the Company's Privacy Policy and applicable data protection laws.

Personal information may be processed for purposes including:

  • account management;
  • Artist discovery;
  • enquiries;
  • Booking processing;
  • payments;
  • customer support;
